Firm VMG Salsoul alleges it sampled horns and strings from Salsoul Orchestra’s 1977 Love Break (Ooh I Love It).
Its lawsuit also names producer Shep Pettibone, who is said to have re-mixed Love Break before working on 1990’s Vogue.
The papers say: “The unauthorised sampling was deliberately hidden.
“It was only when VMG looked for the sample, with the technology available in 2011, that it could be confirmed.”
VMG, based in Delaware, US, wants damages “in addition to profits attributable to the copyrighted material”.
It claims it gave Madonna, 53, notice a year ago. The Salsoul Orchestra split in 1982.-SUN UK
